Any subscription of an order of advertising at Europe compare ltd implies the acceptance of our payment and conditions of sale.
Advertising appears under the only responsibility of the advertiser.
Europe compare ltd reserves the right to refuse purely and simply any publicity even in the course of execution, and more particularly when by its nature, its text or its presentation, publicity appears contrary with the spirit of the site or likely to cause protests on behalf of its visitors or of third.
No complaint will be allowed if it were not carried out in writing or by e-mail in the 8 days following the date of setting on line.
No complaint concerning a delay in the setting on line of a publicity will be allowed if it were not mentioned on the order of publicity “day of rigor, if not to remove” or if it were not indicated a deadline of setting on line.
The advertiser is responsible for the payment of the advertisements put on line at the conditions defined on the tariff.
All taxes present or future with the load of the advertiser and are invoiced in addition.
Europe compare ltd cannot be held responsible for problems of connection, of unavailability or data transmission, of the network.
The offered products always get along subject to availability at the time of acceptance of the order by Europe compares ltd. In addition to the case aimed to article 2 above, Europe compare ltd can also be brought to move, neutralize, give up or remove publicity. According to the circumstances, Europe compare ltd reserves faculty or to terminate the contract, or to let it follow its course. The advertiser will be able to it to be opposed under about eight to reception the notification, in the absence of what, its agreement will be famous asset. Tarifs
The principle of subscription gives the right to the Agency to diffuse its real advertisements, to height of the contract subscribes, on the basis of tariff mentioned in the form of subscription of subscription. Europe compare ltd however reserves the right to revise its tariffs with each renewal of subscription. Any modification of tariffs will then be notified at least 2 months before the expiry of the subscription in progress. Tariffing is established according to the number of spaces advertisements occupied on the site europe-comparee.com insofar as this number of spaces advertisements to be diffused is lower or equal to the type of contract subscribes. If the number of occupied spaces advertisements had suddenly been higher than the subscribed contract, E.C ltd will contact the Chief of Publicity in load of its file in order to change fixed price during the contractual period. The Agency wishing to subscribe for the first time at Europe compare ltd must address all the required information, in particular an order of taking away and a bank account number with our accounting department.
Invoicing:
Any publicity is payable cash with the handing-over of the order, that is to say by bank card or transfer (fresh with the load of the customer).
Any delay of payment will automatically involve:
- the suspension of the execution of the contract,
- immediate current liability of all the invoiced sums remainder due and of the orders not yet invoicees,
- the cash payment with the handing-over about all new setting on line or the suspension of their execution,
- an invoicing of post maturity interest calculated at the rate equal toonce and half the adjustable legal rate of interest to reception by bank check,
- current liability of an allowance of 15% of the sums due under penalty clause, in addition to the possible legal expenses.
All our invoices are payable in London.
Orders
The advertiser wishing for the first time to pass an order to Europe compare ltd must address any information required by this last, in particular intended for its accounting department.
The orders of publicity must arrive to Europe compares ltd either in electronic form, or by fax.
The technical time and specifications are those specified in the tariffs and the documents of passage of a nature in force.
In the event of nonrespect of these deadlines and technical specifications, the responsibility for Europe compares ltd could not be committed.
The modifications or cancellations of the orders could be made only within one time higher than 3 days before the date of setting on line.
Except for a specific forfeit clause concluded and accepted between the parts, the fulfilment of a contract in progress cannot be cancelled by the customer.
Responsability
It is up to the customer to ensure his own computer security. Europe compare ltd could not be held responsible for any accidental or voluntary damage caused with the customer by thirds or their connection to Internet network.
It is up to the customer to be ensured of the compatibility of its information processing system or of that of third with the applications developed and diffused by Europe compare ltd.
Europe compare ltd could not be held responsible for the bad quality or of the dysfunction of information processing systems belonging or operated by thirds lodging or diffusing the data-processing bonds giving access to the products marketed by Europe ltd compares or of their incompatibility with the applications developed or distributed by Europe ltd compares.
Europe compare ltd does not intervene in any way in the drafting of the texts of the advertisements to diffuse which concerns the exclusive responsibility for the Agency which transmitted them. Moreover, Europe compare ltd does not guarantee the outputs of the advertisements diffused by its care. Europe compares ltd reserves the right to refuse purely and simply any text of advertisement which, in his opinion, appears incompatible with the finalities of the service offered or appears likely to cause protests of third. The Agency expressly begins to guarantee Europe compares ltd of any responsibility possibly incurred by Europe compare ltd in the process of real transaction. Europe compares ltd will not be able to in no case to be held responsible for the problems of routing or cut of telephone call or technical problems independent of its will affecting the diffusion of information relating to the goods proposed.
The Customer makes his personal deal of the acquisition of all the rights and authorizations necessary to the diffusion on line on Advertizing Spaces, in such a way that Europe compare ltd cannot never be worried on this subject by any third estimating to have undergone an act of counterfeit. When publicity gives access to other Internet sites via hyperlinks, the Customer is responsible for obtaining and the payment for all the rights and authorizations necessary to the diffusion of his hyperlinks towards the aforementioned sites. He guarantees, if necessary, to have obtained the authorization to create these hyperlinks and in particular if they are major bonds hyper-text. The Customer guarantees that the contents of the message related to the agency do not contravene any regulation or legislation in force, does not comprise any defamatory or detrimental charge with regard to the thirds and respects the recommendations in accordance with the European Court of the humans right. In no circumstance the agency must give access by hyperlinks to Internet sites to the contents of defamatory nature, or counterfeiting, or in an illicit and/or bearing general way reached with the law and order and the moralities. The Customer commits himself guaranteeing Europe completely compares ltd of any judgment pronounced with his opposition because of diffusion to the message related to the agency and the hyperlinks placed on the agency. The present guarantee relates in particular to all damages or fines with which Europe compares ltd would be condemned, and extends to the court expenses. Europe compares ltd reserves the possibility of refusing or of suspending the diffusion of an agency whose diffusion would be likely to harm its public image; whose form or contents seems to him illicit or immoral; or for any other reason without having to justify itself in this respect. In this case, the Agency with faculty to propose a new presentation within 72 hour as from the notification of the refusal or the suspension. If it does not use of this faculty, the contract will be automatically solved or cancelled.
Cause Beyond Control
In the event of cause beyond control, Europe compares ltd could not be responsible for any damage which could be undergone by the customer. Are in particular constitutive of case of absolute necessity the following events: war, riot, strike, fire, explosion, flood, cyclone, earthquake, sabotage, data-processing virus, failure of an information processing system or any other event independent of the will of Europe compare ltd and likely to compromise the execution of its services.
